Federal Laws and Penalties
While District of Columbia residents have passed Initiative 71 legalizing the possession and home cultivation of marijuana for personal use under DC law, those provisions only apply when one is on DC property; not federal property. (Federal land comprises 18 square miles within the District of Columbia.)
Marijuana possession remains a federal offense, and the federal law applies to offenses committed on federal property, which includes the Capitol grounds and the mall within DC, as well as all national parks and military property nationwide, and other land under federal control.
Federal law also applies to offenses involving interstate commerce and importation from other countries.
Possession of marijuana is punishable by up to one year in jail and a minimum fine of $1,000 for a first conviction. For a second conviction, the penalties increase to a 15-day mandatory minimum sentence with a maximum of two years in prison and a fine of up to $2,500. Subsequent convictions carry a 90-day mandatory minimum sentence and a maximum of up to three years in prison and a fine of up to $5,000.
Distribution of a small amount of marijuana, for no remuneration, is treated as possession. Manufacture or distribution of less than 50 plants or 50 kilograms of marijuana is punishable by up to five years in prison and a fine of up to $250,000. For 50-99 plants or 50-99 kilograms the penalty increases not more than 20 years in prison and a fine of up to $1 million if an individual, $5 million if other than an individual for the first offense. Manufacture or distribution of 100-999 plants or 100-999 kilograms carries a penalty of 5 – 40 years in prison and a fine of $2-$5 Million. For 1000 plants or 1000 kilograms or more, the penalty increases to 10 years – life in prison and a fine of $4-$10 Million.
Distribution of greater than 5 grams of marijuana to a minor under the age of 21 doubles the possible penalties. Distribution within 1,000 feet of a school, playground, public housing or within 100 feet of a youth center, public pool or video arcade also doubles the possible penalties.
The sale of paraphernalia is punishable by up to three years in prison.
The sentence of death can be carried out on a defendant who has been found guilty of manufacturing, importing or distributing a controlled substance if the act was committed as part of a continuing criminal enterprise – but only if the defendant is (1) the principal administrator, organizer, or leader of the enterprise or is one of several such principal administrators, organizers, or leaders, and (2) the quantity of the controlled substance is 60,000 kilograms or more of a mixture or substance containing a detectable amount of marijuana, or 60,000 or more marijuana plants, or the if the enterprise received more than $20 million in gross receipts during any 12-month period of its existence.
Mandatory Minimum Sentence
When someone is convicted of an offense punishable by a mandatory minimum sentence, the judge must sentence the defendant to the mandatory minimum sentence or to a higher sentence. The judge has no power to sentence the defendant to less time than the mandatory minimum. A prisoner serving an MMS for a federal offense and for most state offenses will not be eligible for parole. Even peaceful marijuana smokers sentenced to “life MMS” must serve a life sentence with no chance of parole.

I am not a lawyer or legal expert so please take anything I saw with a grain of salt. However, I’ve been growing since 2008 and running GrowWeedEasy.com to teach other people how to grow weed since 2010. Despite talking to literally thousands of growers who’ve ordered cannabis seeds online, I’ve never heard of a single example of someone getting in trouble with the law due to it. Not even in states where growing weed is strictly illegal, and not even as a secondhand story about someone else. It may be technically illegal to own cannabis seeds, but there don’t seem to be many prosecutions against cannabis seeds in the United States.
People rarely get in trouble for ordering cannabis seeds online.
However, that doesn’t mean there’s no risk.
You never know when it comes to the American legal system, but from what I’ve seen, your risks with ordering cannabis seeds online are typically social and involve growing as opposed to the actual ordering process. When growers get in trouble, it’s nearly always due to the wrong person finding out about the grow. Whether it’s a nosy neighbor, your plants smelling up the neighborhood, or telling someone you grow weed. But when it comes to seeds, don’t tell your friends you plan to buy seeds because if you suddenly start showing up with a ton of amazing weed they’re going to realize you’re growing it. So if you plan to order seeds online, keep it to yourself.
How to protect yourself when ordering seeds online
- [Most Important] Order from a trusted cannabis seed bank that sells good genetics. Don’t get scammed with bad seeds or someone who takes your money and doesn’t send anything.
- Don’t tell anyone in your life that you plan to buy cannabis seeds or grow. They will remember your words when you suddenly start overflowing with dank weed and realize you’re growing.
- (Optional) Pay with crypto like Bitcoin or Ethereum or another anonymous payment method (I personally order with my regular bank debit card but I live in California)
- (Optional) Order to a second home address if you have one, but this is likely unnecessary.

Remember when it comes to buying seeds: Real seed businesses don’t contact you. They let you contact them. If anyone messages you to sell you seeds on social media, look out! It’s possible they will take your payment and send nothing. Always take a second to think before sending money to anyone, especially if they contact you (whether by DM, text message, phone call, email, etc.).

Look here’s the deal you are one small peaon in a great war. Yes there is a chance of getting caught bring seeds into the us, but it about the same chance as crossing the street and getting hit by a car. First off get a prepaid card, second order from a reputable comany. i.e. attitude, don’t be a fool and opt out for the stealth shipping. pay for it. never ship seeds were you are growing big mistake. That’s what Johnny Law wants plants, not some measly old seeds. If you get a letter from the post office saying you got a package to come and get. fuck it chuck it up as a loss and move on. Lastly if seeds do get caught in customs, the only repercussion you have to fear is a pretty pink slip letting you know that the importation of cannabis seeds in the us is illegal.
